A note before you read:

We wrote these Terms of Service to actually be readable. We want you to understand what you are agreeing to — not just click through it. Please take a few minutes to read this.

1. Who we are

DEW is a wellness and capacity tracking platform operated by Doing Everyday Well LLC, a North Carolina limited liability company located at 197 Crawford Parkway, Clayton, NC 27520. When we say DEW, we, us, or our in this document we mean Doing Everyday Well LLC.

When we say you or user we mean you — the person who created a DEW account and agreed to these terms.

2. Acceptance of terms

By creating a DEW account and using the platform you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms please do not use DEW.

These terms constitute a legally binding agreement between you and Doing Everyday Well LLC.

3. Eligibility

You must be at least 18 years old to use DEW. By creating an account you confirm that you are 18 years of age or older. If we learn that a user is under 18 we will terminate their account immediately.

DEW is available to users worldwide. However we make no representation that the platform is appropriate or available in all locations. It is your responsibility to ensure that your use of DEW complies with the laws of your local jurisdiction.

4. Your account

When you create a DEW account you are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account.

You agree to provide accurate and complete information when creating your account. You agree to keep your account information updated and accurate.

You may not share your account with another person. Each account is for a single individual user only.

If you believe your account has been compromised please contact us immediately at support@doingeverydaywell.com.

5. Subscriptions and billing

  1. DEW offers a subscription plan called the Founding Member plan billed at $29.99 every three months. All new subscriptions begin with a seven day free trial. You will not be charged until your free trial ends.

  2. Payment is processed securely through Stripe. By providing your payment information you authorize us to charge your payment method at the start of each billing period.

  3. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you will retain access to DEW until that date.

  4. We do not offer refunds for partial billing periods except where required by applicable law. If you cancel mid-period you will continue to have access to DEW until the period ends and you will not be charged for the next period.

  5. We reserve the right to change our pricing at any time. We will give you at least 30 days notice before any price change takes effect for your account. If you do not agree to the new pricing you may cancel your subscription before the price change takes effect.

6. Free trial

Your seven day free trial begins on the date you provide your payment information. If you do not cancel before the trial ends your first quarterly charge of $29.99 will be processed automatically on day eight.

Each user is eligible for one free trial. If you cancel during your trial and create a new account to access another trial we reserve the right to charge you for the full subscription.

7. What DEW is and is not

DEW is a wellness and capacity tracking platform designed to help you monitor your energy, build self-care habits, and prevent burnout. DEW is for informational and self-improvement purposes only.

DEW is not a medical service. DEW is not a mental health service. DEW is not therapy. DEW is not a crisis service. The content and tools available inside DEW are not a substitute for professional medical advice, diagnosis, or treatment.

If you are experiencing a mental health crisis please contact a qualified mental health professional or call a crisis helpline in your area. DEW is not equipped to provide emergency support.

Never disregard professional medical advice or delay seeking it because of something you read or experienced inside DEW.

8. Your content

DEW allows you to create content including community posts, comments, and profile information. You retain ownership of the content you create.

By posting content inside DEW you grant Doing Everyday Well LLC a non-exclusive, royalty-free, worldwide license to display and distribute your content within the DEW platform for the purpose of operating the service. We will never sell your content or use it for advertising purposes.

You are solely responsible for the content you post. You agree not to post content that is unlawful, harassing, threatening, defamatory, obscene, or otherwise objectionable. You agree not to post content that infringes on the intellectual property rights of others.

We reserve the right to remove any content that violates these terms or that we determine in our sole discretion is harmful to the DEW community.

9. Community guidelines

The DEW community — The Group Chat — is a space built on witnessing not fixing. By participating in the community you agree to the following:

  • You will treat other members with kindness and respect at all times.

  • You will not offer unsolicited advice or attempt to fix other members' problems unless explicitly invited to do so.

  • You will not share another member's personal information outside of DEW without their explicit consent.

  • You will not use the community to promote products, services, or external platforms without our written permission.

  • You will not harass, bully, or intimidate other members.

  • Violations of these guidelines may result in removal of your content, suspension of your community access, or termination of your account at our discretion.

10. Intellectual property

All content created by Doing Everyday Well LLC — including the DEW platform design, branding, tools, meditations, journal prompts, boundary scripts, videos, and written resources — is owned by Doing Everyday Well LLC and protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from DEW content without our written permission.

The DEW name, logo, and brand assets are trademarks of Doing Everyday Well LLC. You may not use our trademarks without our written permission.

11. Privacy

Your privacy matters to us deeply. Please read our Privacy Policy which is incorporated into these Terms of Service by reference. It explains how we collect, use, and protect your personal information.

12. Termination

You may terminate your account at any time by deleting your account from the Settings screen inside DEW or by contacting us at support@doingeverydaywell.com.

We reserve the right to suspend or terminate your account at any time if we determine that you have violated these Terms of Service, engaged in fraudulent activity, or otherwise acted in a way that is harmful to DEW or its community members. If we terminate your account for cause we will not refund any portion of your current billing period.

13. Platform changes and shutdown

We reserve the right to modify, suspend, or discontinue DEW or any part of it at any time with or without notice. We will make reasonable efforts to provide advance notice of significant changes.

In the event that Doing Everyday Well LLC closes and ceases operations we will notify all active users by email as soon as reasonably possible. Users will have up to six months from the date of the closure notice to request a copy of their personal data by contacting support@doingeverydaywell.com. After that six month period we cannot guarantee the availability of your data.

If DEW shuts down we will issue a prorated refund for any unused portion of a paid subscription period to the payment method on file.

14. Disclaimer of warranties

DEW is provided on an as-is and as-available basis. Doing Everyday Well LLC makes no warranties, express or implied, regarding the platform including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that DEW will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from using DEW will be accurate or reliable.

15. Limitation of liability

To the fullest extent permitted by applicable law Doing Everyday Well LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of DEW or your inability to access DEW.

Our total liability to you for any claim arising from these terms or your use of DEW will not exceed the amount you paid to us in the three months preceding the claim.

16. Governing law

These Terms of Service are governed by the laws of the State of North Carolina without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved in the courts of North Carolina.

17. Changes to these terms

We may update these Terms of Service from time to time. When we make material changes we will notify you by email and by posting a notice inside DEW. Your continued use of DEW after the changes take effect constitutes your acceptance of the updated terms.
